Terms

1. General

Spybrain GbR offers group experience rooms for small groups of 3-8 people. Persons aged 11 and over are eligible to participate. Children up to the age of 16 must be accompanied by an adult and have the consent of a parent or guardian. The event is not suitable for people with mental illness, asthma, heart disease or other serious illnesses. Each participant must ensure that he/she is in a healthy physical and mental condition. He/she confirms this by accepting these T&C.

2. booking conditions

Spybrain Escape events can only be booked via their own homepage www.spybrain-escape.de. The person making the booking must be 18 years of age or older at the time of booking. The booking is confirmed by a booking confirmation number. The confirmation and invoice will be sent to the e-mail address you entered in the order process. Please inform us immediately of any errors in the invoice/booking.

3. prices / payment

Full payment must be made before the start of the game. This can be done in advance by Paypal/bank transfer/credit card. Cash and card payment is possible at the venue at Kartäuserwall 53. A binding contract between you and us comes into being upon receipt of the booking confirmation/invoice. The current price is displayed when you book and includes VAT. In the event of errors in advertised or confirmed prices, we reserve the right to correct these as soon as we become aware of the error.

4. withdrawal/cancellation

As soon as you have received a booking confirmation, you can only change or cancel your booking with a notice period of 14 days before the booked date.
Withdrawal by the customer (cancelations on your part): The sale of tickets for a musical, theater, concert, sports or other leisure event does not constitute a distance selling contract (“Fernabsatzvertrag”) as of § 312b BGB (German legislation applies). This means that the customer has no right of withdrawal and no right of return. Each booking of an appointment is therefore binding and obliges you to pay for the booked appointment.
Cancellations/changes on our part: Should we have to cancel or change an appointment due to unforeseeable events, you have the right to accept this change or to receive a full refund of the purchase price.

The exchange or refund of vouchers is excluded.

Exchanges and refunds for online games or outdoor rallies are also excluded.

5. force majeure

We accept no liability and/or compensation in the event of force majeure.

6. liability

6.1
We shall only be liable for simple negligence – except in the event of injury to life, limb or health – if material contractual obligations (cardinal obligations) are breached. Liability is limited to the foreseeable damage typical of the contract, but not exceeding the amount of the ticket price booked.

6.2
Liability for indirect and unforeseeable damage, loss of production and use, loss of enjoyment, loss of profit, loss of savings and financial loss due to third-party claims is excluded in the event of simple negligence – except in the event of injury to life, limb or health.

6.3
Any further liability beyond the scope of this contract is excluded, regardless of the legal nature of the claim asserted. However, the above limitations or exclusions of liability shall not apply to strict liability prescribed by law (e.g. under the German Product Liability Act) or liability under a no-fault guarantee.

6.4
Insofar as liability is excluded or limited in accordance with Sections 1 and 2, this shall also apply to the personal liability of employees, workers, representatives, organs and agents of Spybrain GbR.

7 Other terms and conditions

7.1
Please arrive punctually for your booked appointment. Any delays must be deducted from the playing time. The entrance fee will not be refunded.

7.2
Visitors are liable for any damage they cause on the premises.

7.3
Persons under the influence of alcohol or drugs are not permitted to enter – the admission price will not be refunded.

7.4
The entire premises/facilities and the story are protected by copyright. Audio and video recordings are not permitted.

7.5
Smoking is not permitted in the playrooms. The consumption of food and drinks brought into the premises is also not permitted. Pets are not allowed.
